Overview
Welcome to RallyCam. The terms “we,” “us,” and “our” refer to RallyCam.
RallyCam operates this store and website, including all related information, content, features, tools, products, and services, in order to provide you with a shopping experience for wearable sports camera headsets, related accessories, and associated products.
RallyCam is powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with the policies referenced herein, describe your rights and responsibilities when accessing our store or purchasing our products.
Please read these Terms of Service carefully, as they contain important information regarding purchasing conditions, product use, shipping, warranties, returns, refunds, recording responsibilities, limitations of liability, and other legal rights and responsibilities.
By visiting, interacting with, or purchasing from our store, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree with these Terms, you must not use or access our Services.
Section 1 — Access and Account
By agreeing to these Terms of Service, you represent that you are of legal age in your place of residence or that you have authorization from a parent or legal guardian where required by applicable law.
To complete a purchase, we may request information including your name, email address, telephone number, shipping address, billing address, and payment information.
You represent that all information you provide is accurate, current, and complete.

Section 2 — Our Products
RallyCam sells wearable sports camera headsets, audio-enabled sports accessories, camera-enabled wearable products, and related accessories.
We make reasonable efforts to represent our products accurately.
However, colors, dimensions, appearance, finish, texture, camera angle, field of view, perceived image quality, stabilization, audio characteristics, fit, weight perception, and overall presentation may vary depending on factors including:
- Lighting conditions.
- Camera exposure.
- Screen settings.
- Device display settings.
- Recording conditions.
- Player movement.
- Head movement.
- Environmental conditions.
- Connected device or app settings.
- Compression or social-media processing.
- Manufacturing batches.
We do not guarantee that the appearance, color, camera output, recorded footage, perceived stabilization, audio, fit, or overall visual presentation of a product will be identical to photographs, videos, advertisements, renderings, social-media content, or other visual representations displayed by RallyCam.
Personal preference regarding fit, comfort, camera angle, field of view, perceived video quality, stabilization, audio quality, color, size, weight, or overall appearance is not considered a manufacturing defect by itself.
Product specifications, packaging, finishes, accessories, components, software compatibility, or minor cosmetic details may vary slightly between production batches provided that such variations do not materially affect the product's intended function.
All product descriptions, specifications, prices, images, availability, accessories, and features are subject to change where reasonably necessary and without prior notice.
We reserve the right to modify, update, replace, or discontinue products at any time.
Section 3 — Product Use and Customer Responsibility
Customers are responsible for reviewing and following any instructions, specifications, warnings, compatibility requirements, or recommendations supplied with the product or provided through our store.
RallyCam products must be used responsibly and consistently with their intended purpose.
Customers are responsible for determining whether:
- The activity and environment are appropriate for the product.
- The product is properly fitted and securely worn.
- The product is properly maintained and stored.
- The product is charged using appropriate equipment.
- The product is being used within its intended specifications.
- The connected phone, app, operating system, or other device is compatible where applicable.
- Use of the camera or audio-recording function is lawful and permitted in the relevant location or activity.
Customers should not cut, dismantle, modify, repair, alter, open, puncture, excessively bend, or otherwise change a product unless expressly permitted by product documentation.
Improper use, modification, misuse, or operation outside the product's intended specifications may damage the product and may void applicable warranty coverage.
Section 4 — Sports, Indoor, and Outdoor Use
Certain RallyCam products may be suitable for recreational sports, training, indoor use, and outdoor use.
However, an indication that a product may be used outdoors or during athletic activity does not necessarily mean that it is suitable for:
- Swimming or submersion in water.
- Heavy rain or prolonged water exposure.
- Flooding or standing water.
- Excessive moisture.
- Severe storms.
- Extreme temperatures.
- Sand, mud, excessive dust, or harsh environmental exposure.
- High-impact collisions.
- Long-term outdoor storage.
Unless expressly stated otherwise in the applicable product specifications, customers should take reasonable precautions to avoid environmental exposure beyond the product's intended use.
Damage caused by environmental exposure, impact, or use outside the product's specifications is not considered a manufacturing defect.
Ordinary recreational sports and training use does not by itself void warranty coverage.
Section 5 — Physical Damage, Wear, and Athletic Activity
Customers are responsible for using the product in appropriate environments and taking reasonable care during athletic activity.
Different activities may result in different levels of wear, abrasion, cosmetic deterioration, or damage.
RallyCam does not guarantee that the product will remain free from scratches, scuffs, dirt, sweat residue, abrasion, discoloration, finish wear, or cosmetic changes during normal use.
To the maximum extent permitted by applicable law, RallyCam is not responsible for damage caused by:
- Drops.
- Falls.
- Collisions.
- Direct impacts.
- Rackets, balls, fences, walls, floors, or sports equipment.
- Sharp objects.
- Crushing.
- Excessive bending or twisting.
- Animals.
- Vehicles.
- Intentional misuse.
- Improper storage.
- Other external causes unrelated to manufacturing defects.
Normal wear resulting from ordinary athletic, recreational, or day-to-day use is not considered a manufacturing defect.
Section 6 — Charging, Battery, Ports, and Power Use
Customers are responsible for using reasonable care when charging or connecting the product.
RallyCam is not responsible for damage caused by:
- Use of damaged, unsuitable, or incompatible charging equipment.
- Excessive force applied to charging ports or connectors.
- Improper insertion or removal of charging cables.
- Exposure of ports or connectors to water, debris, or contamination.
- Unauthorized battery replacement.
- Disassembly or modification.
- Charging in extreme heat or cold.
- Improper power sources.
- Other improper charging practices.
Battery life and charging duration may vary depending on camera use, audio use, connection status, settings, temperature, age of the product, and other operating conditions.
Gradual battery-capacity reduction caused by normal use and aging is not considered a manufacturing defect by itself.
Damage resulting from improper charging, battery handling, or port use may not qualify for warranty coverage.
Section 7 — Recording, Privacy, and Venue Rules
RallyCam products may include camera, audio, or hands-free recording functionality.
Customers are solely responsible for using these functions in compliance with all applicable laws, regulations, privacy requirements, consent requirements, venue policies, school rules, club rules, league rules, tournament rules, workplace rules, and other restrictions.
The availability of a recording function does not mean that recording is permitted in every location or situation.
Customers are responsible for determining whether audio or video recording is lawful and permitted before using the recording function.
RallyCam is not responsible for penalties, disputes, claims, suspensions, removals, losses, or other consequences resulting from a customer's unlawful or unauthorized recording, publication, sharing, or use of recorded content.
Section 8 — Safety and Situational Awareness
RallyCam is not protective equipment and is not designed to prevent injury.
Customers are responsible for using the product safely and maintaining appropriate awareness of their surroundings.
Users should not operate, adjust, view, or interact with the product in a manner that distracts them from traffic, other players, equipment, hazards, instructions, or surrounding activity.
Customers are responsible for selecting an appropriate audio volume and complying with applicable safety rules.
Use during sports or physical activity is at the user's own discretion and should be discontinued if the product interferes with safe participation.
Section 9 — Orders
By placing an order with RallyCam, you are submitting an offer to purchase.
We reserve the right to accept, decline, limit, or cancel an order for legitimate reasons including:
- Suspected fraud.
- Payment verification issues.
- Pricing errors.
- Inventory limitations.
- Incorrect or incomplete information.
- Invalid or inaccessible shipping addresses.
- Abuse of promotions or discounts.
- Violation of our policies.
An order is not considered fully accepted until payment has been successfully processed and the order enters fulfillment or processing.
Your purchases are eligible for warranty coverage, replacement, return, exchange, reshipment, or refund only in accordance with RallyCam's published policies.
You represent that products purchased through our store are intended for lawful personal or household use unless otherwise agreed in writing.
Unauthorized commercial resale or distribution may be restricted.
Section 10 — Prices, Promotions, and Billing
Prices, discounts, offers, coupons, promotions, bundles, and other purchasing incentives may change without prior notice.
The price applicable to your purchase will generally be the price displayed at the time your order is submitted and confirmed.
Unless expressly stated otherwise, prices may not include:
- Customs duties.
- Import taxes.
- Local taxes.
- Bank fees.
- Currency conversion fees.
- Payment-provider fees.
- Other charges imposed by third parties.
You agree to provide complete, accurate, and current billing, payment, and account information.
RallyCam reserves the right to cancel or correct an order involving:
- An obvious pricing error.
- Fraudulent activity.
- Unauthorized payment.
- Coupon abuse.
- Promotion manipulation.
- Technical errors affecting pricing or checkout.
Section 11 — Shipping and Delivery
Delivery times displayed by RallyCam are estimates and are not guarantees.
Shipping times may vary due to:
- Customer location.
- Carrier operations.
- Customs procedures.
- Seasonal demand.
- Holidays.
- Weather.
- Transportation disruptions.
- High order volume.
- International logistics.
- Events outside our reasonable control.
RallyCam is not responsible for delays caused by shipping carriers, customs authorities, incorrect customer information, recipient unavailability, failure to collect a package, or other circumstances outside our reasonable control.
The customer is responsible for providing a complete, accurate, and accessible delivery address.
If a shipment cannot be completed because the customer supplied incorrect, incomplete, inaccessible, or otherwise undeliverable information, RallyCam may not be required to provide a refund and the customer may be responsible for additional shipping costs, subject to applicable law.
Shipping claims are subject to our applicable Shipping Policy and Returns and Warranty Policy.
Section 12 — Packages Marked as Delivered
Once a carrier marks an order as delivered, RallyCam will generally consider its delivery obligation fulfilled.
RallyCam is not responsible for packages that are marked as delivered but are subsequently claimed by the customer to be missing when carrier tracking confirms delivery, except where applicable law requires otherwise.
Customers should check:
- Their delivery location.
- Mailboxes or parcel areas.
- Reception desks.
- Building staff.
- Household members.
- Neighbors.
- Other persons who may have accepted the delivery.
A package received by another person at the delivery address or at a customary receiving location may constitute completed delivery.
This section does not limit any mandatory consumer right that cannot lawfully be excluded.
Section 13 — Warranty, Returns, Replacements, and Refunds
All warranty claims, returns, exchanges, replacements, reshipments, and refunds are governed by our Returns and Warranty Policy.
RallyCam provides a 60-day limited warranty beginning on the date the carrier marks the order as delivered, subject to the conditions contained in that policy.
The 60-day limited warranty is not:
- An unconditional trial period.
- A satisfaction guarantee.
- A general right to use a product for 60 days and return it.
- A right to obtain a refund simply because the customer changed their mind.
- A guarantee that the product will satisfy every subjective expectation.
Where an unused return is authorized, the product must satisfy all applicable return conditions, including being:
- Complete.
- Unused, except where limited use was reasonably necessary to verify an approved defect.
- Clean.
- In its original condition, subject to the approved defect.
- Returned with original packaging when required.
- Returned with all components or accessories originally supplied.
RallyCam may reject a return if the product, packaging, accessories, or components are missing, damaged, excessively used, altered, dirty, modified, dismantled, or otherwise fail to comply with the approved return conditions.
Section 14 — Damaged or Defective Products
Visible shipping damage or damage present upon arrival must be reported within 3 calendar days after delivery, in accordance with our Returns and Warranty Policy.
Customers may be required to provide photographs and/or videos showing:
- The complete product.
- Packaging.
- Shipping label.
- Components.
- Accessories.
- Reported damage or defect.
For alleged functional or product-related problems, RallyCam may require customers to complete reasonable verification or troubleshooting steps before a claim is approved.
This may include demonstrating:
- The reported product issue.
- Camera functionality.
- Audio functionality.
- Charging behavior.
- Buttons or controls.
- Phone or app connectivity.
- Product fit or physical condition where relevant.
- The environment or conditions in which the issue occurs.
- Any alleged defect.
Failure to provide reasonably requested evidence or complete reasonable verification may prevent RallyCam from confirming a claim.
Section 15 — Warranty Exclusions
Unless otherwise required by applicable law, warranty coverage does not apply to problems caused by circumstances including:
- Normal wear and tear.
- Ordinary athletic or recreational use.
- Surface abrasion.
- Cosmetic scuffs or scratches.
- Dirt, sweat residue, or staining.
- Gradual discoloration.
- Wear of finish or flexible surfaces.
- Normal battery aging or gradual battery-capacity reduction.
- Improper charging.
- Damage to charging ports or connectors caused by improper handling.
- Use of incompatible or damaged charging equipment.
- Misuse.
- Negligence.
- Accidents.
- Falls.
- Collisions.
- Abnormal impacts.
- Cuts.
- Punctures.
- Sharp objects.
- Crushing.
- Excessive bending or twisting.
- Modification.
- Dismantling.
- Unauthorized repairs.
- Improper handling.
- Environmental exposure outside stated specifications.
- Prolonged water exposure.
- Submersion.
- Flooding.
- Excessive moisture.
- Severe weather.
- Extreme environmental conditions.
- Failure to follow applicable instructions.
- Problems caused solely by incompatible or misconfigured third-party phones, apps, operating systems, or devices.
Normal deterioration resulting from ordinary use is not considered a manufacturing defect.
Section 16 — Camera, Audio, Fit, and Subjective Expectations
The performance and appearance of RallyCam recordings may vary depending on:
- Lighting conditions.
- Camera angle.
- Head position.
- Player movement.
- Running, jumping, serving, turning, or rapid direction changes.
- Distance from subjects.
- Environmental noise.
- Wind.
- Connected device settings.
- App settings.
- Screen settings.
- Video compression.
- Social-media processing.
- Playback device.
- Other environmental or technical conditions.
RallyCam does not guarantee that footage, audio, stabilization, framing, field of view, or product appearance will be identical under every condition.
Photographs, videos, advertisements, demonstrations, and other marketing materials may show the product under specific camera, lighting, motion, editing, or environmental conditions.
Differences in perceived:
- Video sharpness.
- Camera angle.
- Field of view.
- Stabilization.
- Audio quality.
- Color.
- Brightness.
- Appearance.
- Fit.
- Comfort.
- Size.
- Weight.
- Product feel.
- Perceived value.
are not considered manufacturing defects by themselves.
Customer dissatisfaction based solely on subjective preference, perceived value, fit preference, comfort preference, visual expectations, or personal expectations does not create an automatic right to a return, replacement, or refund.
Section 17 — Compatibility with Phones, Apps, and Third-Party Devices
Certain RallyCam functions may depend on a compatible phone, app, operating system, wireless connection, storage availability, permissions, or third-party service.
RallyCam does not guarantee compatibility with every phone, operating-system version, app version, software update, network configuration, or third-party device unless expressly stated in the applicable product documentation.
Customers are responsible for ensuring that their device and software meet applicable compatibility requirements.
Changes made by third-party software providers, operating-system developers, app providers, or device manufacturers may affect functionality.
Where appropriate, customers may be required to complete reasonable troubleshooting or compatibility checks before a product claim is approved.
Section 18 — Free Gifts, Bonus Products, and After-Sales Items
Products provided free of charge, complimentary products, bonus items, promotional extras, goodwill products, replacement accessories, and other items for which the customer did not separately pay a purchase price are not independently eligible for monetary refunds.
A complimentary item's value may not be converted into cash or used as the basis for a separate refund.
Items supplied as part of an after-sales resolution are also not independently refundable unless RallyCam expressly agrees otherwise in writing.
Where appropriate, RallyCam may offer another reasonable resolution for an eligible problem with a complimentary item.
Section 19 — Intellectual Property
Our Services, including our:
- Brand name.
- Logos.
- Text.
- Photographs.
- Graphics.
- Videos.
- Audio.
- Designs.
- Website structure.
- Product presentation.
- Advertising materials.
- Marketing concepts.
- Collection names.
- Proprietary visual elements.
may be owned by RallyCam, its suppliers, licensors, contractors, or other applicable rights holders and may be protected by relevant intellectual property laws.
These Terms allow you to access our store for personal and lawful purposes.
You may not reproduce, distribute, modify, republish, sell, commercially exploit, transmit, or otherwise misuse protected RallyCam materials without authorization or another lawful basis.
Section 20 — Optional Tools and Applications
Our store, Services, or products may interact with third-party software, applications, platforms, phones, devices, or tools.
We may also provide access to third-party features over which RallyCam does not exercise full control.
Third-party technologies, devices, platforms, software updates, browser settings, app permissions, operating systems, or network configurations may affect the availability or operation of certain features.
RallyCam does not guarantee uninterrupted availability of third-party software or services.
Your use of external tools or services may also be subject to the third party's own terms and privacy practices.
Section 21 — Third-Party Links
Our store may include links to third-party websites, payment services, social media networks, applications, shipping providers, product-support tools, or other external resources.
RallyCam does not control these third parties and is not responsible for their:
- Content.
- Availability.
- Security.
- Terms.
- Privacy practices.
- Products.
- Services.
Transactions or interactions with third parties may be subject to separate contractual terms.
Section 22 — Relationship with Shopify
RallyCam is powered by Shopify.
However, purchases made through our store are transactions between the customer and RallyCam, subject to the applicable role of any payment provider or other third party.
Shopify is not the seller of RallyCam products and is not responsible for product performance, fulfillment, shipping, warranties, returns, refunds, or customer-service decisions made by RallyCam.
Section 23 — Privacy Policy
Our handling of personal information is governed by our Privacy Policy.
By using our Services, you acknowledge that personal information may be collected, used, disclosed, and processed as described in that policy and as permitted by applicable law.
Section 24 — Comments, Reviews, and Submitted Content
If you voluntarily submit:

you grant RallyCam a worldwide, non-exclusive, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, display, distribute, and incorporate that content into marketing, advertising, commercial, or promotional materials, subject to applicable law.
You represent that:
- You have the right to submit the content.
- Your submission does not violate another person's intellectual property, privacy, publicity, consent, or other legal rights.
- Your content is not intentionally false, fraudulent, unlawful, defamatory, or misleading.
- Where your submitted content depicts or records other people, you have any permissions or legal basis required to submit and authorize use of that content.
We reserve the right to moderate, reject, remove, or decline to publish content that violates our policies or applicable law.
Section 25 — Errors, Inaccuracies, and Omissions
Our store may occasionally contain errors, inaccuracies, or omissions relating to:

- Warranty abuse.
- Return abuse.
Nothing in this section prevents a customer from exercising legitimate rights available under applicable law or through their payment provider.
Section 28 — Automated Agents
If software, scripts, automated services, bots, or similar technologies access our Services on your behalf, they must comply with these Terms and applicable law.
We reserve the right to block, limit, or restrict automated access that threatens or interferes with:

- Availability.
- Performance.
- Data integrity.
- Store operations.
Section 29 — Termination
We may suspend accounts, restrict access, cancel pending orders, or terminate access to our Services when reasonably necessary because of:

Termination does not eliminate payment obligations or legal responsibilities incurred before termination.

To the maximum extent permitted by applicable law, RallyCam does not guarantee that:
- Website access will always be uninterrupted.
- All third-party services will remain continuously available.
- Every feature will operate without interruption or error.
- Products will satisfy every customer's subjective expectations.
- Product appearance will be identical in every environment.
- Recorded footage will appear identical under every lighting or motion condition.
- Stabilization will eliminate all movement.
- Audio will be identical in every environment.
- Battery duration will be identical under every usage pattern.
- Fit or comfort will be identical for every user.
- A wearable sports product will remain cosmetically unchanged during ordinary use.
Product photographs, videos, descriptions, demonstrations, and advertisements are intended to help represent the product but may not perfectly reproduce its appearance, recording output, audio, fit, or performance under every lighting, camera, screen, motion, device, or environmental condition.
Section 31 — Limitation of Liability
To the maximum extent permitted by applicable law, RallyCam will not be liable for indirect, incidental, special, punitive, exemplary, or consequential losses arising from the use of our Services or products.
This may include losses resulting from:
- Shipping delays.
- Missed events, games, matches, tournaments, trips, birthdays, or gift-giving occasions.
- Customer errors in shipping information.
- Improper product use.
- Damage caused by misuse.
- Improper charging.
- Incompatible third-party devices or software.
- Environmental exposure beyond product specifications.
- Normal wear resulting from use.
- Customer-specific expectations regarding camera footage, audio, fit, comfort, stabilization, or appearance.
- Loss, corruption, or failure to capture a recording where such loss results from circumstances outside our reasonable control.
- Unauthorized or unlawful recording by the customer.
- Violations of venue, school, club, league, tournament, or third-party rules.
- External carrier failures.
- External service-provider failures.
Where liability cannot lawfully be excluded but may lawfully be limited, RallyCam's aggregate liability relating to a particular product will not exceed the amount actually paid for that product, except where applicable law requires otherwise.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.
Section 32 — Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless RallyCam, Shopify, and applicable affiliates, suppliers, contractors, service providers, employees, and partners from claims, damages, liabilities, losses, and reasonable legal expenses resulting from:
- Your material violation of these Terms.
- Your unlawful use of the Services or product.
- Your unlawful or unauthorized recording, publication, or sharing of content.
- Your infringement of third-party intellectual property, privacy, publicity, consent, or other legal rights.
- Fraudulent or intentionally wrongful conduct attributable to you.
Section 33 — Severability
If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be interpreted or limited to the maximum extent legally permissible.
The remaining provisions will continue in effect to the extent permitted by law.
Section 34 — Waiver and Entire Agreement
Failure by RallyCam to exercise or enforce a provision of these Terms does not automatically constitute a waiver of that provision or right.
These Terms, together with the policies incorporated or referenced through our store, constitute the agreement governing your use of RallyCam Services, subject to rights that cannot be excluded under applicable law.
Section 35 — Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent where consent may lawfully be required.
RallyCam may transfer or assign its rights and obligations when reasonably necessary in connection with:
- Operational changes.
- Corporate restructuring.
- Financing.

Any such transfer will remain subject to applicable law.
