Product Purpose

RallyCam products are wearable sports technology products, camera-enabled sports headsets, audio-enabled accessories, and related products intended primarily for recreational, personal, and household use.

Our products are designed to allow customers to enjoy hands-free audio and, where applicable, capture point-of-view video or photographs during sports, training, recreational activities, and everyday use.

Unless expressly stated otherwise, RallyCam products are not intended to serve as certified professional competition equipment, protective equipment, safety equipment, emergency equipment, medical equipment, surveillance equipment, or any other specialized professional or safety system.

Customers are responsible for using each product only for its intended purpose and in accordance with applicable product instructions, specifications, warnings, venue rules, privacy requirements, and reasonable safety precautions.

Product Use

RallyCam products must be handled and used appropriately.

Customers are responsible for:

• Using the product only for its intended recreational, sporting, audio, or recording purpose.
• Following applicable product instructions and warnings.
• Ensuring that the product is fitted and worn appropriately.
• Maintaining and storing the product appropriately.
• Charging the product with suitable equipment.
• Taking reasonable precautions during indoor and outdoor use.
• Avoiding conditions likely to cause preventable damage.
• Using the recording function only where lawful and permitted.
• Maintaining awareness of surrounding players, traffic, equipment, and hazards.
• Discontinuing use if the product becomes visibly unsafe, materially damaged, or interferes with safe participation.

Customers should not cut, puncture, dismantle, open, repair, modify, alter, excessively bend, or otherwise change the product unless expressly permitted by the applicable product documentation.

Improper use, unauthorized modification, misuse, or use outside the product's intended specifications may result in damage and may affect warranty eligibility.

Recreational and Sporting Use

RallyCam products are intended primarily for ordinary recreational, personal, athletic, and training use.

Unless expressly stated otherwise, our products are not represented as:

• Certified professional competition equipment.
• Official league equipment.
• Protective sports equipment.
• Safety equipment.
• Medical devices.
• Certified coaching or performance-analysis systems.
• Certified tournament recording equipment.
• Equipment approved for use in every school, club, venue, league, or competition.

The product's fit, recording perspective, field of view, stabilization, audio performance, battery duration, comfort, and overall experience may differ depending on the user, activity, environment, movement, and settings.

Such differences do not by themselves constitute product defects.

Customers are responsible for determining whether the use of RallyCam is permitted during a particular match, event, tournament, practice session, class, club activity, workplace activity, or other organized setting.

Indoor and Outdoor Use

Certain RallyCam products may be suitable for both indoor and outdoor use.

However, outdoor use does not automatically mean that a product is waterproof, weatherproof, impact-proof, suitable for immersion, or designed for unrestricted exposure to severe environmental conditions.

Unless a specific water-resistance or waterproof rating is expressly stated in the applicable product information, customers should exercise reasonable care when using products outdoors or during exercise.

Products should not be intentionally exposed to:

• Submersion in water.
• Flooding.
• Standing water.
• Heavy or prolonged rain.
• Excessive moisture.
• Severe storms.
• Extreme temperatures.
• Sand, mud, excessive dust, or other harsh environmental conditions.
• Long-term outdoor storage under adverse conditions.

Damage caused by exposure beyond the product's stated or reasonably intended specifications may not qualify as a manufacturing defect.

Ordinary recreational athletic or outdoor use does not by itself void applicable warranty coverage.

Normal Wear and Tear

RallyCam products are wearable electronic products and naturally experience wear through repeated use.

Normal wear and tear may include:

• Scuffs.
• Surface marks.
• Scratches.
• Dirt, sweat residue, or staining.
• Surface abrasion.
• Gradual discoloration.
• Minor cosmetic deterioration.
• Wear caused by repeated contact with skin, hair, clothing, hats, visors, towels, or sports equipment.
• Minor changes in surface appearance or texture.
• Normal wear of flexible parts, ear hooks, contact surfaces, or exterior finishes.
• Gradual battery-capacity reduction resulting from ordinary use and aging.

Normal deterioration resulting from ordinary use is not considered a manufacturing defect.

Warranty coverage applies only to eligible defects as described in our Returns and Warranty Policy.

Charging, Battery, and Connector Responsibility

Customers are responsible for charging and handling RallyCam products correctly and using appropriate charging equipment.

RallyCam is not responsible for damage caused by:

• Use of damaged, unsuitable, or incompatible charging equipment.
• Excessive force applied to charging ports or connectors.
• Improper insertion or removal of charging cables.
• Exposure of charging ports or connectors to water, debris, sweat residue, or contamination.
• Unauthorized battery replacement.
• Disassembly.
• Electrical damage caused by inappropriate power sources.
• Charging under extreme environmental conditions.
• Other improper charging practices.

Battery life may vary depending on camera use, audio playback, call use, connection status, device settings, temperature, recording duration, battery age, and other operating conditions.

Gradual reduction in battery capacity over time is normal for rechargeable electronic products and is not necessarily a manufacturing defect.

Physical Damage and Misuse

RallyCam is not responsible for damage resulting from misuse, negligence, accidents, abnormal use, or external physical causes.

This may include damage caused by:

• Drops.
• Falls.
• Collisions.
• Direct impacts.
• Contact with rackets, balls, walls, floors, fences, or other sports equipment.
• Cuts.
• Punctures.
• Sharp objects.
• Crushing.
• Vehicles.
• Animals.
• Excessive force.
• Excessive bending or twisting.
• Intentional damage.
• Improper storage.
• Unauthorized modification.
• Use inconsistent with the product's intended purpose.

Such damage is not generally considered a manufacturing defect.

User Responsibility and Safety

The customer is responsible for using RallyCam products responsibly and with reasonable regard for personal safety, surrounding people, and property.

Customers should:

• Use the product in a suitable area.
• Maintain awareness of other players, traffic, equipment, obstacles, and hazards.
• Avoid using the product in a manner that distracts from safe participation.
• Use an appropriate audio volume.
• Avoid handling or adjusting the product during moments when doing so may be unsafe.
• Follow applicable facility, school, club, tournament, league, workplace, or venue rules.
• Stop using the product if it becomes materially damaged or unsafe.
• Follow any warnings or instructions supplied with the product.

RallyCam is not protective equipment and is not intended to prevent injuries.

RallyCam is not responsible for consequences resulting from reckless behavior, misuse, unsafe play, distraction, failure to follow applicable rules, or use outside the product's intended purpose.

Recording, Privacy, Consent, and Legal Responsibility

RallyCam products may include camera, video, photography, audio, or hands-free recording functionality.

Customers are solely responsible for ensuring that their use of these functions complies with all applicable:

• Privacy laws.
• Recording-consent laws.
• Audio-recording laws.
• Video-recording laws.
• Venue policies.
• School rules.
• Club rules.
• League rules.
• Tournament rules.
• Workplace rules.
• Property rules.
• Other legal or contractual restrictions.

The fact that the product includes a recording function does not mean that recording is permitted in every location or situation.

Customers are responsible for obtaining any consent, authorization, or permission that may be required before recording, publishing, sharing, uploading, or otherwise using footage or audio involving other people.

RallyCam does not authorize unlawful surveillance, stalking, harassment, invasion of privacy, or other unlawful recording activity.

RallyCam is not responsible for penalties, disputes, claims, suspensions, removals, losses, or other consequences resulting from a customer's recording, publication, sharing, or use of content in violation of applicable law or third-party rules.

Camera, POV, Stabilization, and Visual Expectations

Camera footage, perceived image quality, stabilization, framing, field of view, recorded color, and overall visual appearance may vary depending on factors including:

• Lighting conditions.
• Time of day.
• Indoor or outdoor environment.
• Camera angle.
• Head position.
• Player movement.
• Running, jumping, serving, turning, or rapid direction changes.
• Product fit and placement.
• Distance from the subject.
• Recording settings.
• Connected phone or app settings.
• Screen brightness.
• Screen calibration.
• Device display settings.
• Video compression.
• Social-media processing.
• Environmental conditions.
• Manufacturing variations.
• Individual perception.

RallyCam is designed to provide hands-free point-of-view recording when used as intended.

However, RallyCam does not guarantee that:

• Stabilization will eliminate all movement.
• Every recording will be perfectly level or centered.
• Every subject will remain within the frame.
• The field of view will match every user's personal expectation.
• Footage will appear identical under every lighting or motion condition.
• Recorded color or brightness will be identical to what the user perceives in person.
• Every moment of a sporting activity will be captured exactly as intended by the user.

These differences do not by themselves indicate a manufacturing defect.

Subjective dissatisfaction or personal expectations regarding video sharpness, camera angle, stabilization, field of view, brightness, color, framing, or visual appearance do not automatically create eligibility for a refund, return, replacement, or warranty claim.

Audio and Call Expectations

Where RallyCam includes audio playback, microphone, or hands-free call functionality, perceived audio performance may vary depending on:

• Ambient noise.
• Wind.
• Player movement.
• Device volume.
• Product fit.
• Connected phone.
• Wireless connection.
• App or operating-system settings.
• Distance from the connected device.
• Environmental conditions.

RallyCam does not guarantee that audio, microphone, or call performance will be identical in every environment.

Subjective preferences regarding sound, volume, bass, microphone pickup, or call quality do not by themselves constitute a manufacturing defect.

Fit and Comfort Expectations

RallyCam is a wearable sports headset.

Fit and comfort may vary from person to person based on factors including:

• Head shape.
• Ear shape.
• Hairstyle.
• Hats or visors.
• Eyewear.
• Clothing.
• Movement style.
• Personal sensitivity.
• Individual fit preference.

A subjective preference that the product feels too tight, too loose, too noticeable, or different from expected does not by itself constitute a manufacturing defect.

A verifiable structural or manufacturing defect that prevents the product from being worn or used as intended may be reviewed under the applicable warranty policy.

Product Images and Marketing Content

Product photographs, videos, demonstrations, advertisements, renderings, and marketing materials may be created under specific lighting, camera, editing, environmental, or viewing conditions.

Visual media may be affected by:

• Camera exposure.
• Photography setup.
• Screen brightness.
• Color reproduction.

• Editing.
• Lighting.

• Environmental conditions.

Marketing content is intended to illustrate product appearance and use but does not guarantee that the product or resulting recordings will appear identical under every real-world condition.

Nothing in this section permits RallyCam to materially misrepresent a product or its essential characteristics.

Product Variations

Minor differences may occur between production batches.

These may include reasonable variations in:

• Packaging.
• Printed elements.
• Surface finish.
• Texture.
• Color tone.
• Minor dimensions.
• Minor weight tolerances.
• Button placement or cosmetic details where functionally equivalent.
• Accessory presentation.
• Other minor cosmetic details.

Such variations are not considered defects when they do not materially affect the product's:

• Advertised function.
• Essential characteristics.
• Overall design.
• Intended use.

A materially different product, missing advertised feature, substantially different design, or significant functional variation will not be treated as a minor manufacturing variation.

RallyCam reserves the right to make reasonable product, packaging, or presentation changes where necessary.

Phone, App, and Third-Party Device Compatibility

Certain RallyCam functions may depend on a compatible phone, application, operating system, wireless connection, device permissions, storage availability, or other third-party hardware or software.

Unless expressly stated otherwise, RallyCam does not guarantee compatibility with every:

• Smartphone model.
• Tablet.
• Operating-system version.
• Software update.
• App version.
• Wireless environment.
• Third-party device.
• Third-party service.

Compatibility or functionality may change as third-party software, platforms, devices, or operating systems are updated.

Customers are responsible for meeting any compatibility requirements described in the applicable product information.

Issues caused solely by unsupported, outdated, misconfigured, restricted, or incompatible third-party hardware or software are not necessarily product defects.

Limitation of Liability

To the maximum extent permitted by applicable law, RallyCam is not responsible for indirect, incidental, special, consequential, exemplary, or similar damages resulting from:

• Improper product use.
• Unsafe activity.
• Negligence.
• Distraction during use.
• Improper charging.
• Physical damage caused by misuse.
• Unauthorized modification.
• Environmental exposure beyond stated specifications.
• Failure to follow applicable instructions.
• Customer-specific camera, audio, fit, comfort, or performance expectations.
• Failure to capture a particular moment or recording.
• Loss or corruption of recordings due to circumstances outside RallyCam's reasonable control.
• Incompatible third-party devices, apps, or software.
• Unlawful or unauthorized recording.
• Violations of venue, league, school, club, tournament, workplace, privacy, or consent rules.

This may include losses associated with:

• Damage to personal property caused by improper use.
• Product deterioration caused by misuse.
• Missed sporting events, matches, tournaments, trips, or gift-giving occasions.
• Delays caused by third-party carriers.
• Penalties or disputes resulting from unauthorized recording.
• Other consequences arising from circumstances outside RallyCam's reasonable control.

Where liability may legally be limited, RallyCam's aggregate liability relating to a particular product will not exceed the amount actually paid for that product, except where applicable law provides otherwise.

Nothing in this Legal Notice is intended to exclude, restrict, or limit any liability or consumer right that cannot legally be excluded or limited.

No Guarantee of Specific Performance

Except where expressly stated in applicable product specifications, RallyCam does not guarantee that a product will:

• Produce identical footage under all conditions.
• Eliminate all camera movement.
• Produce identical stabilization under every activity.
• Produce identical audio quality in every environment.
• Fit every user identically.
• Remain cosmetically unchanged after use.
• Achieve identical battery duration under every usage pattern.
• Maintain uninterrupted compatibility with every third-party phone, app, or operating system.
• Capture every desired moment, angle, or subject.
• Meet every customer's subjective preference.

Individual experience may vary depending on use, movement, environment, fit, settings, connected device, lighting, battery condition, and other factors.

Third-Party Services and Platforms

RallyCam may use or interact with third-party services or platforms in connection with:

• Payments.
• Shipping.
• Tracking.
• Website hosting.
• Analytics.
• Advertising.
• Customer communications.
• Order fulfillment.
• Mobile apps.
• Operating systems.
• Wireless connectivity.
• Cloud or media services where applicable.

Availability or performance of these services may be affected by circumstances outside RallyCam's control.

RallyCam cannot guarantee the uninterrupted availability or performance of third-party platforms, carriers, payment providers, apps, operating systems, connected devices, or external services.

Use of third-party services may also be subject to the respective third party's own terms and privacy policies.

Intellectual Property

All RallyCam website content, including where applicable:

• Brand names.
• Logos.
• Text.
• Product descriptions.
• Images.
• Videos.
• Graphics.
• Advertising materials.
• Website structure.
• Collection names.
• Proprietary designs.
• Marketing content.

is owned by RallyCam, its licensors, suppliers, contractors, or the respective rights holders and may be protected by applicable intellectual property laws.

Unauthorized reproduction, publication, distribution, modification, commercial exploitation, or use of protected content is prohibited except where legally permitted or expressly authorized in writing.

Third-Party Intellectual Property

Certain products, images, visual elements, technologies, services, or other materials associated with our Services may incorporate or refer to intellectual property belonging to third parties.

All third-party trademarks, service marks, product names, logos, technologies, platforms, sporting organizations, clubs, leagues, tournaments, and other protected materials remain the property of their respective owners.

Unless expressly stated otherwise, the appearance of a third-party name, brand, platform, technology, sporting organization, club, league, retailer, tournament, or other reference does not imply sponsorship, endorsement, authorization, partnership, distribution, retail availability, or affiliation with RallyCam.

Changes to Products and Content

RallyCam reserves the right to modify, update, improve, replace, or discontinue products, product descriptions, images, specifications, prices, promotions, website content, or availability where reasonably necessary.

Minor product or packaging changes may occur between manufacturing batches without affecting the product's essential function.

We may correct errors, inaccuracies, or outdated information when reasonably necessary.

If a material error affects a completed order, the matter will be handled in accordance with applicable law and our published policies.
